E2C instance unreachable - Rebuilding question

An EC2 instance has become unreachable and support has note responded to impairment status request as of yet (> 24 hours)

Question is : the instance is a MS Server 2012 and If I took this opportunity to start another instance with Server 2022 could I attach the volume from the unreachable instance as a second drive in the 2022 instance so I can get whatever files I may need as I migrate? Perhaps clone the volume first in case Amazon Support can restore the EC2 instance to a bootable state.

Yep - create a snapshot (https://docs.aws.amazon.com/AWSEC2/latest/UserGuide/ebs-creating-snapshot.html) of the volume, then you can restore the snapshot and attach it as a secondary volume to a new server.
