The answer is fairly simple - Dont install the Standard edition but the data centre edition. The licence agreement will be checked BEFORE the restart and during the install process in the running instance

We ended up with the same problem, even though I'd selected Datacenter edition for the upgrade. It was fixed by connecting remotely to the registry and putting in place the following registry key and then rebooting.
HKEY_LOCAL_MACHINE\SOFTWARE\Microsoft\Windows\CurrentVersion\Setup\OOBE\SetupDisplayedEula, of type REG_DWORD, and value 0x1
We did all the work through the Windows Admin Center, but I guess it could be done through remote registry and the AWS Console.
